Terms and Conditions of Use

1. Acceptance of Terms
By accessing, registering, or using the Molevi platform (hereinafter, "the Platform"), operated by Molevi S.A.S. (hereinafter, "Molevi"), with domicile in Bogotá, Colombia, you freely, expressly, and informedly accept these Terms and Conditions of Use (hereinafter, "the Terms"). If you do not agree with any of these Terms, please refrain from using the Platform.
These Terms are governed by Colombian law, in particular Law 1480 of 2011 (Consumer Statute), Law 527 of 1999 (Electronic Commerce), and are compatible with Mexico's Federal Consumer Protection Law, Brazil's Consumer Defense Code (Law 8,078/1990), Peru's Consumer Protection and Defense Code (Law 29571), and other applicable legislation in Latin America.
2. Definitions
"Buyer": the person who purchases the Molevi service as a gift for a loved one. "Narrator": the person who receives the Buyer's invitation and shares their life stories through the Platform. "Book" or "Digital Book": the final product generated by the Platform, consisting of a digital document (PDF or other format) that compiles the Narrator's responses in an editorial format. "User Content": any text, audio, video, image, or other material that the Narrator or Buyer inputs into the Platform. "AI" or "Artificial Intelligence": the artificial intelligence systems used by the Platform to facilitate the interview and generate the Book.
3. Service Description
Molevi is a digital platform that allows a Buyer to gift a Narrator (typically a grandparent, father, or mother) the experience of telling their life story. The Platform uses artificial intelligence to guide the Narrator through personalized questions, collect their responses in text, audio, or video format, and generate a professionally formatted digital book.
The service includes: (a) question customization by the Buyer; (b) invitation sent to the Narrator; (c) AI-assisted conversational interface for the Narrator; (d) progress tracking for the Buyer; (e) on-demand Digital Book generation.
4. Registration and User Account
To use the Platform, the Buyer must register by providing a valid email address. Authentication is done via magic link sent to the registered email address. The Narrator accesses the Platform through a unique link provided by the Buyer, without needing to create an account.
The user is responsible for maintaining the confidentiality of their access and all activities performed under their account. Molevi shall not be liable for unauthorized access resulting from the user's negligence in protecting their access information.
5. Purchases and Payments
Payments are processed through Wompi, an authorized and regulated payment gateway. By making a purchase, you accept Wompi's terms of service. Molevi does not store credit card data or sensitive financial information.
Prices are displayed in Colombian Pesos (COP) and include applicable taxes under Colombian tax law. Molevi reserves the right to modify prices, which will not affect purchases already made.
Right of withdrawal: In accordance with Article 47 of Law 1480 of 2011 (Colombian Consumer Statute), the Buyer has the right to withdraw from the purchase within five (5) business days following the acquisition, provided that the Narrator has not begun using the service (i.e., has not answered any questions). Once the Narrator has started the response process, the service will be considered used and withdrawal will not apply. To exercise this right, contact hola@molevi.co.
6. Intellectual Property
The Platform, its design, source code, logos, trademarks, trade names, and other elements are the exclusive property of Molevi and are protected by Andean Decision 486 (Industrial Property), Andean Decision 351 (Copyright), Colombian Law 23 of 1982, and applicable international treaties.
The editorial format, design templates, and Book generation algorithms are Molevi's property. However, User Content (stories, responses, multimedia files) is and shall remain the property of the Narrator and/or Buyer, as applicable.
7. User Content and License
The Narrator and Buyer retain all rights to User Content. By using the Platform, you grant Molevi a limited, non-exclusive, revocable license necessary only to: (a) process the content through AI to generate the Book; (b) securely store the content during the service period; (c) deliver the Digital Book to the Buyer.
Molevi will NOT use User Content to train artificial intelligence models, sell it to third parties, or for any purpose other than providing the contracted service. Audio and video files are stored encrypted using presigned URLs on secure Amazon Web Services (AWS S3) servers.
The user represents and warrants that User Content does not infringe third-party rights, does not contain illegal, defamatory, obscene material, or material that violates human dignity.
8. Personal Data Protection
The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms. We invite you to review it to learn in detail how we collect, use, store, and protect your personal data, in compliance with Law 1581 of 2012 (Colombia), Brazil's General Data Protection Law (LGPD), Mexico's Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), and Peru's Law 29733.
9. Prohibited Use
The following is expressly prohibited: (a) using the Platform for illegal, fraudulent, or unauthorized purposes; (b) attempting to access other users' accounts or restricted areas of the Platform; (c) introducing viruses, malware, or any malicious code; (d) reproducing, distributing, or modifying the Platform without authorization; (e) using the Platform to harass, defame, or violate third-party rights; (f) reverse engineering the Platform or its AI components; (g) introducing content that promotes violence, discrimination, pornography, or any illegal activity.
Molevi reserves the right to immediately suspend or cancel access to any user who violates these prohibitions, without prejudice to corresponding legal actions.
10. Limitation of Liability
Molevi shall not be liable for: (a) temporary service interruptions due to maintenance, updates, or force majeure; (b) the truthfulness, accuracy, or completeness of User Content; (c) indirect, incidental, or consequential damages arising from the use of the Platform; (d) failures in third-party services (payment gateway, cloud providers, AI services).
In any case, Molevi's maximum liability to the user shall be limited to the amount actually paid by the user for the contracted service, in accordance with applicable legislation.
11. Warranties and Availability
Molevi is committed to providing the service with reasonable diligence and quality. The Platform is provided "as is." We do not guarantee that the service will be uninterrupted or error-free. We strive to maintain 99.5% availability, but assume no responsibility for interruptions beyond our control.
The Digital Book is generated by artificial intelligence from the Narrator's responses. Molevi does not guarantee that the result will be exhaustive or reflect the entirety of the Narrator's life story, as this depends on the responses provided.
12. Termination and Suspension
The user may stop using the Platform at any time. To request account and data deletion, contact hola@molevi.co. Deletion will be processed within the periods established by applicable data protection legislation.
Molevi may suspend or cancel a user's access in case of: (a) breach of these Terms; (b) fraudulent or illegal activities; (c) requests from competent authorities. In case of cancellation, Molevi will retain data for the legally required period.
13. Modifications to the Terms
Molevi reserves the right to modify these Terms at any time. Modifications will take effect upon publication on the Platform. We will notify registered users about substantial changes via email at least fifteen (15) days in advance.
Continued use of the Platform after publication of modifications constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of the Republic of Colombia. If the user resides in another Latin American country, mandatory consumer protection regulations applicable in their jurisdiction of residence will be respected, in accordance with private international law principles.
In particular, for users in Brazil, the rights of the Consumer Defense Code (Law 8,078/1990) are recognized; for users in Mexico, those of the Federal Consumer Protection Law; and for users in Peru, those of the Consumer Protection and Defense Code (Law 29571).
15. Dispute Resolution
The parties will attempt to resolve any dispute amicably. Failing that, disputes shall be submitted to the Superintendency of Industry and Commerce of Colombia (SIC) as the consumer protection authority, or to the competent courts of Bogotá, Colombia.
For users in other Latin American countries, the right to appeal to consumer protection authorities in their respective jurisdiction of residence is recognized: PROFECO in Mexico, PROCON/SENACON in Brazil, INDECOPI in Peru.
